Important Information about your Career in Real Estate in Winnipeg
WinnipegREALTORS® Other Occupation Policy
 
WinnipegREALTORS® Constitution and By-Laws requires that salespeople and alternate brokers (who are not partners/owners of their brokerage) shall have “no occupation other than in the real estate business”.  
 
WinnipegREALTORS® policy defines other occupation as any employment/engagement from which is received a wage, salary or commission from any employer other than the Broker member with whom the member is registered. 
 
Adhering to the Other Occupation Constitution and By-Laws/Policies means that:
 
You must:
·         Engage in real estate as your principal occupation.
·         Devote the principal part of your time to real estate.
 
You must not: 
·         Have other employment/engagement that requires regular hours.
·         Have other employment/engagement that provides a regular weekly/bi-weekly/monthly salary.
·         Have other employment/engagement that produces a payment from an employer other than from the Broker.
·         Have other employment/engagement that generates a T4.
 
Reporting
 
If you think that the Constitution and By-Laws/ Policies are not being adhered to in regards to Other Occupation the complaint process is as follows:
 
1. Send a written complaint to WinnipegREALTORS® outlining the allegation. The complaint cannot be anonymous.
 
2. Once a complaint is received WinnipegREALTORS® staff will contact the Broker/Manager of the office involved to discuss the matter.  
 
3. If the correspondence received from the Broker/Manager is not acceptable, the issue will be referred to the Investigative Committee who will review the complaint/response and recommend either A. that the matter be dismissed or B.  that a hearing be held. 
 
4. A hearing panel would make the final decision as to whether the Constitution and By-Laws/Policy was offended or not.
 
5. WinnipegREALTORS® members should be aware that the fine system for brokerages in contravention is $1000 for the first offence and  $3000 for the second. In each instance, the salesperson/alternate broker would be terminated from WinnipegREALTORS® membership.   
 
Finally, anyone elected to federal, provincial or municipal politics must apply for “inactive” status during their term of office. Individuals elected or appointed to Boards, Commissions, Panels and other governmental positions that do not require lengthy sittings, but require one or two days/nights a week attention, will not be required to apply for "inactive" status (this may also include Municipal office in the outlying regions of Winnipeg).
