On the recommendation of legal counsel from the Canadian Real Estate Association (CREA) and WinnipegREALTORS'® legal counsel the display of this information is considered a violation of the federal privacy legislation - The Personal Information Protection and Electronic Documents Act (“PIPEDA”). This information will be permanently removed from SABRE.
With regards to REALTORS® ascertaining whether or not a listing has been a Grow – Op , the courts would examine, “What is the duty of a reasonable agent?” The Realtor can both utilize the Winnipeg Police Service website and also ask specific questions of the seller to meet the standard of a reasonable agent reducing or eliminating their liability.
